Neighboring rights: performers, producers and sound recordings
Neighboring rights relate to recorded performances and sound recordings. The same track can therefore generate rights for the work’s creators, performers and the owner of the master.
Performer
A singer, musician, conductor, DJ or other performer may hold rights in the use of a recorded performance. In France, ADAMI is one of the relevant organizations for performers.
Phonogram producer
The producer who takes the initiative and responsibility for a recording holds rights in the sound recording. In France, SCPP manages certain payments and licenses for member producers.
Which uses are covered?
Public performance, radio, television, private copying, certain digital uses and international exploitation may generate payments depending on applicable law.
Which data should be retained?
ISRC, recording title, version, primary artist, participating performers, producer, label, fixation date, territory and contracts are essential data.
What about the United States?
SoundExchange collects and distributes certain digital performance royalties for sound recordings used by non-interactive services.
